Terms for creating, sharing, and viewing virtual CDs through Burn CD.

Acceptance of These Terms

By accessing or using Burn CD, you agree to these Terms of Service. If you do not agree, do not use the Service.

The Service

Burn CD is a web-based creative tool for making and sharing virtual CDs. It lets you search a music catalog, choose tracks, add an optional note, play available short previews, and create a share link. Burn CD does not burn physical discs, sell music, provide full-length streaming, or grant rights to download, copy, or redistribute music.

The Service is currently offered without a charge for its core features. We do not currently charge any fees and have no plans to do so. We may change, suspend, or discontinue features at any time. We may, at our discretion, delete shared CDs that are inactive, abusive, or reported to us.

Age

You must be at least 14 years old to use the Service. If you are under 14, do not use Burn CD.

Shared Links and Your Content

When you create a shared CD, its tracks, cover selection, and optional note are available to anyone with the link. You are responsible for every note and any other information you choose to include.

Do not submit content that is unlawful, infringing, defamatory, harassing, hateful, deceptive, invasive of privacy, or otherwise harmful. Do not include sensitive personal information (such as government ID numbers, financial accounts, health information, biometric data, or other people's information without their consent) or any other confidential information in a shared CD. We may remove or restrict shared CDs when necessary to enforce these Terms, comply with law, or protect users and the Service.

Removing a CD You Created

Because no account is required, we cannot identify you from a CD on our own. If you want a CD you created removed, email contact@burncd.online with the share link and any information that helps us verify the request. We will action verified requests within 30 days.

Music Content and Third Parties

Music catalog data, artwork, previews, and store links are supplied by Apple/iTunes and other applicable rights holders. They are not owned by Burn CD, and their availability may change without notice.

You may use previews only through the functionality provided by the Service. You may not download, record, save, cache, synchronize, reproduce, distribute, or otherwise exploit music previews or artwork except as permitted by the applicable rights holder or law. Your use of Apple-provided content is also subject to Apple's applicable terms, currently available at Apple's iTunes terms (or the equivalent page on apple.com if that link changes).

Burn CD is not affiliated with, endorsed by, or sponsored by Apple, iTunes, or Apple Music.

Acceptable Use

You agree not to:

  • Violate applicable law or another person's rights.
  • Attempt to bypass security controls, probe the Service, scrape it, or interfere with its operation.
  • Use automated means to create excessive requests, shared CDs, or music searches.
  • Use the Service to distribute spam, malware, or material that harms others.
  • Misrepresent your relationship with Burn CD, Apple, artists, or rights holders.

Intellectual Property

The Burn CD software, design, branding, and original Service content are protected by applicable intellectual-property laws. These Terms do not grant you ownership of them.

You retain any rights you have in your original note. By submitting a note, you grant us the limited, non-exclusive, royalty-free right to store, display, reproduce, and transmit it solely to operate and share the CD you created. This licence ends when the CD is removed from the Service or when you request its removal, whichever comes first.

Music content, artwork, artist names, and related materials remain the property of their respective owners. Nothing in the Service gives you a license to use them beyond the Service's intended functionality.

Copyright Complaints (DMCA-style Notice)

If you believe content made available through the Service infringes your copyright, send a notice to contact@burncd.online that includes:

  1. Your name, address, telephone number, and email address.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works).
  3. The URL or share link of the allegedly infringing material on Burn CD.
  4. A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury (a US legal declaration that the notice is truthful), that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.
  6. Your physical or electronic signature.

We will review and, where appropriate, remove or restrict access to the material. We will retain a record of the takedown. Because the Service does not require accounts, we cannot identify the creator of a CD from the share link alone.

Availability and Disclaimers

The Service and third-party music content are provided on an "as is" and "as available" basis. We do not guarantee that any track, preview, artwork, link, or feature will always be available, accurate, uninterrupted, or error-free.

To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms is intended to override any non-waivable consumer rights you may have under the law of your country of residence.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or use arising from or related to the Service. Where liability cannot be excluded, it is limited to the maximum extent permitted by applicable law.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your content on the Service, or your violation of these Terms or any applicable law, to the extent permitted by applicable law.

Termination

We may suspend or terminate access to the Service at any time, with or without notice, including (without limitation) for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties. You may stop using the Service at any time.

Changes to These Terms

We may update these Terms when the Service or applicable requirements change. The "Last updated" date above shows the most recent revision. Material changes will be reflected by updating that date; continued use of the Service after a change means you accept the updated Terms.

Miscellaneous

  • Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
  • No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
  • Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms to a successor operator of the Service.
  • Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
  • Governing law. These Terms are governed by the applicable laws of the jurisdiction in which we operate, without regard to conflict-of-law rules. Nothing in this clause removes any mandatory protection you have under the consumer law of your country of residence.
